Elderly Rights: Understanding Firearm Transfers in California

In some countries, you have the right to own firearms and learn how to transfer a firearm to another person in california. The Disarmament Statute determines that, during the purchase process, the owner must carry out psychological and shooting assessments, provide proof of moral suitability, and obtain authorization from the Federal Police. However, these steps only give the right to possession and not to carry a firearm.

Possession and Possession of a Firearm: What’s the Difference?

Having the registration of a firearm only entitles the owner to possess it inside his home or at his place of work, provided that the establishment’s owner is responsible for the weapon. Outside these places, it is necessary to carry a Firearm. The Possession of a Firearm is a document issued by the Federal Police. This document allows the weapon’s owner to transport it outside his home or commercial establishment.

The penalty for weapon possession is one to three years in prison and a fine. The penalty for those carrying illegal weapons is two to four years of imprisonment and a fine. For exceptional firearm transport, such as removal from the store or transportation between two addresses, you must request a traffic guide at a Federal Police Station. This guide will authorize the transport of the weapon without ammunition and disassembled.

Requirements and documentation

  • To apply for a firearm, you must:
  • Be at least 25 years old;
  • Prove fixed residence;
  • Have a lawful occupation;
  • Technical and psychological certification of handling, use, and balance for carrying a firearm;
  • Negative certificate regarding criminal record.

 The necessary documents, which must be taken to the Federal Police on the day of the application, are:

Copies of RG, CPF, and proof of residence notarized;

Declaration of need for carrying (the model is available on the Federal Police website);

Negative certificates of criminal records in all legal areas, in addition to proof that there are no criminal investigations or proceedings in progress;

Proof of lawful professional occupation;

Proof of approval in a technical and psychological examination for handling a firearm carried out in at least one year and attested by an instructor  like Barr & Young Attorneys for example accredited by the Federal Police;

Copy of firearm registration certificate;

A recent 3×4 photo.
